1. Company information

2.1 These General Terms and Conditions (GTC) apply to the purchase of tickets for admission to exhibitions of the Österreichische Galerie Belvedere (“Belvedere”), incl. time-slot tickets for the purchase of Belvedere events and programs and the purchase of shop articles via its website www.belvedere.at (subsequently referred to as “offers”). Information on current exhibitions can be found on the website. The Belvedere reserves the right to cancel or alter exhibitions. Parts of the gallery may need to be closed owing to the necessary of work such as the installation, dismantling, or modification of exhibitions. The Belvedere also reserves the right to close exhibition areas or individual rooms for safety reasons due to very large visitor numbers and overcrowding.
2.2 In making an order, the customer accepts the GTC. Only these GTC shall apply. The Belvedere shall not accept differing conditions unless it has expressly done so in writing.
2.3 Should individual provisions of these GTC entirely or partially contradict mandatory statutory regulations, the remaining provisions of these GTC shall nonetheless remain valid.
2.4 A valid version of House Rules can be consulted on the website. In purchasing tickets for exhibitions and events, the customer accepts these House Rules.
2.5 There follows a list of conditions according to the individual product categories and subsequently those conditions applying to all categories.
3.1 The contract language is German.
3.2 After selecting the desired offers and correctly entering all the necessary information, the customer submits a bid for the purchase of the selected offers. An order is only possible if all the fields marked with * (mandatory fields) are completed. The acceptance of the contract by the Belvedere is effected when an e-mail is sent to the email address provided.
4.1 The current prices of offers can be found on the website. All prices include the statutory value-added tax. The Belvedere reserves the right to change prices.
4.2 After acceptance of the contract by the Belvedere, the customer shall receive an email with the tickets for the offers purchased (excluding shop articles, see section VI below, subsequently referred to as “tickets”), which can be stored and printed. The customer is obliged to print out the PDF ticket and bring it on his/her visit, or to show the QR code on his/her mobile device, upon entrance. It is the customer’s responsibility to present a legibly printed ticket. Tickets that are not legible or contain information that cannot be checked will not be accepted. The customer may only print the ticket once and should take all reasonable measures to prevent the duplication of tickets. Tickets are transferable before utilization of the offers. In the event of tickets being passed on, the customer should make sure that the recipient is familiar with the GTC, since these form part of the contract.
4.3 Tickets may not be offered for resale.
5.1 The information required for the respective reduction must be correctly entered in the online form. There is no legal claim to a discount.
5.2 If a customer makes use of a discount on admission, this person must present an official identity document with a photograph in order to verify their entitlement.
5.3 If on conclusion of the contract a reduction was wrongly made use of, the entrance ticket or booking for an event becomes invalid. However, the customer is entitled to pay the difference between the concessionary ticket and a regular ticket; otherwise, he/she will be refused admission to the museum and can be removed from the premises. In this case, the amount already paid shall not be reimbursed, even partially.
6.1 Payment should be made by AMEX, VISA, MasterCard, Diners, PayPal, or Giropay. After sending the order, the purchase is binding and can no longer be canceled or modified. All credit card holders are subject to validation checks. Offers are only considered to be paid once the information provided by the customer has been confirmed as correct and the payment has reached the Belvedere in full. Additional demands shall be made for amounts not confirmed by credit card firms.
7.1 The Belvedere is not legally obliged to ensure that orders can be made via the website at all times. The Belvedere is not liable for defects arising for whatever reason (e.g., damage from disturbances, errors, or disruptions or consequential damages) unless these were occasioned by the Belvedere’s own culpable or negligent behavior.
7.2 The statutory warranty, especially for consumers, remains unaffected by this.
7.3 The customer is obliged to provide the required data fully and correctly. Moreover, the customer is liable for any costs arising from incomplete, incorrect, or unclear information.
8.1 The Belvedere is liable for defects within the framework of the statutory provisions.
10.1 The contract is subject to Austrian law; the provisions of private international law shall be excluded.
10.2 The place of jurisdiction for all conflicts arising from this contract is the court responsible for handling such commercial matters in the 3rd district of Vienna. This does not apply to customers within the meaning of KSchG (Austrian Consumer Protection Act).
1. Period of Validity
1.1 Single tickets and combination tickets are valid for one year from the purchase date (in the Upper Belvedere, only for the selected time slot, in accordance with section III) and may only be used once for the respective offer.
2.1 Purchased tickets can neither be exchanged nor refunded (incl. partially), but are transferable to another person within the period of validity.
1.1 Visitors must book a time slot for the Upper Belvedere. This is included in the ticket price. Admission without a valid time-slot ticket is not possible (with the exception of annual tickets holders). Booking is only possible for a time window shown to be available.
1.2 The time-slot ticket is transferable but time-slot tickets may not be resold.
1.1 After purchasing an annual ticket, the customer shall receive a mobile ticket via email that is immediately valid for one year. Should the customer prefer a paper ticket, this can be sent to them by mail within 14 days or can be issued at one of the Belvedere ticket counters. The annual ticket is personalized and cannot be transferred to another person. A valid identity card with photograph must be presented with the annual ticket.
1.2 Should you lose your ticket, please either email us at email@example.com or notify a staff member at one of the Belvedere ticket counters.
1. Period of Validity
1.1 An event ticket entitles customers to a single participation only. There may be additional costs, e.g., for a museum admission ticket or the use of audio guides (should the customer wish to use them). Event tickets ordered online are valid for one year from the date of the confirmation email.
2. Ticket Refunds/Exchanges
2.1 Purchased tickets can neither be exchanged nor refunded (incl. partially) refunded but are transferable to another person within the period of validity, or can be exchanged for alternative events dates. However, to do so the customer must contact the Belvedere in writing by emailing firstname.lastname@example.org.
2.2 The Belvedere reserves the right to cancel events; the customer shall be informed in good time via email.
1.1 Information on delivery and delivery costs is shown directly within the order process.
1.2 The Belvedere reserves the right to make partial deliveries of orders.
1.3 Goods remain the property of the Belvedere until complete payment has been made.
1.4 Customers have the right to cancel contracts in accordance with the provisions of FAGG (Distance and Off-Premises Contracts Act). In Appendix I you will find the corresponding withdrawal policy and the withdrawal form pursuant to FAGG.
Information on Exercising the Right of Withdrawal Pursuant to FAGG
1. RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days from the day on which you or a third person other than the carrier and indicated by you acquires physical possession of the goods.
To exercise your right of withdrawal from the contract you must inform us (Österreichische Galerie Belvedere, wissenschaftliche Anstalt öffentlichen Rechts, Prinz Eugen-Strasse 27, 1030 Vienna, tel.: +43 1 79557-325, fax: +43 1 79557-121, email@example.com) of your decision to revoke this contract by means of an unequivocal statement (e.g., letter sent by mail, fax, or email). Alternatively, you may use the attached sample withdrawal form but it is not obligatory.
You must send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal:
Should you withdraw from the contract we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of the type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from the contract. Such reimbursement shall use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having returned the goods, whichever is the earliest. You must return the goods or hand them over to us without any undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline shall be considered met if you send the goods before the period of 14 days has expired. You shall bear the direct costs of returning the goods. You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
